These Terms and Conditions are intended to present the core commercial and operating rules that apply to services arranged through CatGo Inc. They are written in a formal style to support clearer expectations for shippers, consignees, and business partners.

1. Applicability

These Terms and Conditions apply to freight services, quote requests, shipment bookings, and related transportation support provided by CATGO INC. Additional commercial terms may apply under a written rate confirmation, bill of lading, credit agreement, or service authorization.

2. Booking Information and Shipment Details

All loads are accepted based on the shipment information supplied by the shipper or its representative, including commodity description, weight, dimensions, packaging, pickup and delivery addresses, appointment requirements, accessorial needs, and handling instructions. Any loss, delay, additional cost, or operational issue resulting from incomplete or inaccurate information remains the responsibility of the shipper.

3. Prohibited, Restricted, and Hazardous Freight

The shipper must disclose in advance whether any load contains hazardous, restricted, oversized, overweight, temperature-sensitive, high-value, or regulated goods. CATGO INC reserves the right to decline, delay, or suspend service where legal compliance, equipment suitability, permits, or safety conditions have not been properly addressed before pickup.

4. Transit Schedules and Service Windows

Pickup dates, delivery windows, and transit expectations are planning estimates unless expressly confirmed in writing as a contractual service commitment. All schedules remain subject to route conditions, weather, traffic, inspections, appointment availability, equipment readiness, labor disruption, and other operating factors outside reasonable control.

5. Force Majeure

CATGO INC will not be liable for delay, non-performance, or service interruption caused by circumstances beyond reasonable control, including but not limited to severe weather, natural disaster, road closures, civil disturbance, strikes, public authority action, inspections, mechanical failure not caused by negligence, or other force majeure events.

6. Packing, Loading, and Freight Condition

The shipper is responsible for ensuring that freight is properly packed, labeled, palletized, braced, and otherwise prepared for normal transportation and handling. Unless separately agreed, the shipper and consignee remain responsible for timely loading and unloading, accurate freight counts, and visible notation of any apparent shortage or damage at the time of delivery.

7. Rates, Charges, and Payment Obligations

Quotes are non-binding until accepted and confirmed. Final charges may be adjusted to reflect actual shipment details, detention, layover, redelivery, storage, accessorial services, tolls, permits, after-hours appointments, driver assist, or other operational costs incurred in service of the load. All undisputed amounts are due according to the agreed payment terms.

8. Claims, Proof of Delivery, and Documentation

Claims for shortage, damage, or loss must be submitted in writing with supporting records, including proof of delivery, freight bill, photographs where available, and commodity documentation. CATGO INC may request additional materials reasonably necessary to evaluate the claim. Failure to preserve shipment records or provide timely written notice may affect claim review.

9. Insurance and Limitation of Liability

Unless otherwise stated in a written agreement, the shipper is responsible for obtaining any insurance coverage it considers appropriate for the shipment. CATGO INC liability, if any, is limited by applicable law, written contract terms, and the documented condition, value, and handling of the freight. CATGO INC is not liable for consequential, indirect, special, or business interruption damages except to the extent required by law.

10. Lien, Storage, and Unclaimed Freight

CATGO INC reserves the right, to the extent permitted by law, to hold freight subject to unpaid transportation, storage, detention, accessorial, or related service charges. If freight is refused, abandoned, or remains unclaimed, CATGO INC may assess storage charges and take commercially reasonable steps available under applicable law or contract to recover outstanding amounts.

11. Website Use and Communications

Use of this website, submission of quote forms, and transmission of booking or load information through digital channels does not by itself create a transportation contract until confirmed by CATGO INC. Electronic communications, dispatch updates, proof-of-delivery records, and related operational messages may be maintained for customer service, compliance, billing, and dispute-resolution purposes.
